The terms and conditions below apply to all group outings of Fair Life Ranch.

 

1. GENERAL TERMS AND CONDITIONS FAIR LIFE RANCH 
a. These General Terms and Conditions are applicable to every legal relationship between on the one hand a consumer who places a booking with Fair Life Ranch and/or a participant who participates in an activity arranged or offered by Fair Life Ranch.
b. These General Terms and Conditions are applicable to every activity of Fair Life Ranch.
c. Upon confirmation of the booking and/or participation in the activity, the consumer declares to agree with these General Terms and Conditions.
d. Fair Life Ranch can change these General Terms and Conditions from time to time. This will be made known via the website www.fairliferanch.com. The latest version is always the valid version and is always available on the website of Fair Life Ranch. A copy of the General Terms and Conditions will be provided upon request.

2. AGREEMENT
a. An agreement with Fair Life Ranch arises by:
- reserving and/or discussing an outdoor sports activity or package for a third party or on behalf of a group (or: consumer).
- Participating in one or more outdoor activity(ies) or arrangement provided by Fair Life Ranch (or: participant).

3. PRICES AND PAYMENT
a. The current prices of the outdoor activities and packages are mentioned on the website of Fair Life Ranch. Fair Life Ranch has the right to increase these prices. The sales price that will be charged is the price used at the time of placing (and confirming) the booking.

b. Payment for the outdoor sports activities or package must be made upon completion. At the adventure locations where Fair Life Ranch operates, payment can be made in cash or by pin.

c. If the situation demands it, Fair Life Ranch can, upon request, deviate from the standard payment and/or the amount to be paid can be paid by means of a deposit note or invoice afterwards.

d. Fair Life Ranch has the right to suspend the execution of its obligations if a consumer has not fulfilled his obligations in time.

 

4. RESERVATION PLACEMENTS AND CANCELLATIONS

a. The reservation of a package or activity is only complete if a request is made in writing by e-mail, after which a confirmation from Fair Life Ranch follows. Arrangements made by telephone or verbally are not considered official reservations.

b. The reservation is only final after a written confirmation has been sent from Fair Life Ranch.

c. A booking with Fair Life Ranch can be cancelled free of charge under the following conditions:
- the cancellation is notified in writing no later than three days before the booked date
- notice of cancellation must be sent to the general e-mail address of Fair Life Ranch: contact@fairliferanch.com.
- the notification of cancellation must clearly indicate which booking and date the cancellation concerns and the reason for cancellation.

d. Any advance payment will be returned if the above conditions are met at the time of cancellation.

e. If a cancellation does not meet one of the above conditions, Fair Life Ranch may decide to charge cancellation costs, or deduct them from the advance payment already made. These charges are 50% of the actual amount of the booking.

f. The booked number of participants can be changed in writing up to 3 working days before booked date with a maximum margin of 10% downwards.

5. PARTICIPATION IN AND CANCELLATION OF A BOOKING
a. In case of force majeure, such as extreme weather conditions, Fair Life Ranch has the right to cancel a booking or change the activities/arrangement at any time.

b. If a booking is cancelled by Fair Life Ranch, in consultation with the consumer, a new date will be scheduled to carry out the activity(s).

6. LIABILITY
a. Participation in activities organized by Fair Life Ranch is at one's own risk.

b. Fair Life Ranch, its employees and instructors are not liable for personal injury or damage to property of a participant in an activity.

c. Fair Life Ranch is not liable for any injury or other damage which a participant may incur during, or as a result of, an activity. Advice is always without obligation and is followed at your own risk. An activity of Fair Life Ranch can be intensive and injury prone. A participant must assess for him/herself whether he/she is fit to participate in an outdoor activity. If a participant has health problems, or any other reason to doubt participation, a participant should seek advice from a doctor.

d. Fair Life Ranch is not liable for damage to and/or loss of personal property due to whatever cause, incurred during or in connection with an activity.

e. Fair Life Ranch reserves the right to exclude unsuitable participants from participation in an activity, at its discretion.

7. WEBSITE; DISCLAIMER AND PRIVACY
a. Fair Life Ranch respects the privacy of its consumers and ensures that the personal and/or confidential information provided and/or obtained (the data) will be treated confidentially.

b. Fair Life Ranch only uses the data to execute the agreement with a consumer as quickly and properly as possible. Otherwise Fair Life Ranch will only use this data with the prior consent of the participant.

c. The information provided on the website www.fairliferanch.com is for general information purposes only. Due to external circumstances, there may be delays, defects and/or other imperfections in the information provided.

8. COMPLAINTS
a. A consumer must report a complaint concerning any performance of Fair Life Ranch to Fair Life Ranch as soon as possible after the defect or damage has been discovered. The complaint must be submitted in writing to Fair Life Ranch (contact@fairliferanch.com) stating the location and a description of the complaint.

b. The complaint must be complete, clearly described and accompanied by any evidence.

c. Fair Life Ranch answers the complaint submitted by the consumer as soon as possible, but at the latest within four (4) weeks from the date of receipt.

d. If the complaint cannot be resolved by mutual agreement a dispute arises in accordance with article 9 sub c of these General Terms and Conditions.

9. DISPUTES AND APPLICABLE LAW
a. Deviation from these General Terms and Conditions is only possible if confirmed in writing by Fair Life Ranch.

b. Portuguese law is applicable to this agreement.

c. Disputes arising from this agreement which cannot be resolved by mutual agreement will be submitted to the competent court.
